Design Registration in Turkey: Rights and Procedure

A registered design protects the appearance of a product in Turkey. Protection can be obtained by a national application or through the Hague system, and the views filed largely determine the scope of the right.

A design right protects the appearance of the whole or a part of a product, resulting from features such as lines, contours, colors, shape, texture, materials or ornamentation. It does not protect the technical function of the product, and features dictated solely by technical function fall outside protection. Product here is understood broadly and includes industrial and handicraft items, packaging, graphic symbols, typographic typefaces and parts intended for assembly into a complex product.

Registration gives the holder the exclusive right to use the design and to prevent third parties from making, offering, marketing, importing, or using products bearing a design that does not produce a different overall impression on the informed user. The comparison is made from the perspective of that informed user, taking into account the degree of freedom available to the designer in developing the design for the product concerned.

Novelty and Individual Character

Two conditions must be met. A design is new if no identical design has been made available to the public anywhere before the filing date or the priority date, designs differing only in immaterial details being treated as identical. A design has individual character if the overall impression it produces on the informed user differs from the overall impression produced by any design already made available to the public.

A grace period of twelve months is available, so a disclosure by the designer or the applicant, or by someone acting on their information, within the twelve months preceding the filing or priority date does not destroy novelty. This is useful where a product was shown at a trade fair before the filing decision was taken, but it should be treated as a remedy rather than a strategy, since other countries apply different rules.

The Views Filed Define the Scope

The representations submitted with the application define what is protected. Turkish practice expects clear views of the design on a neutral background, consistent in scale and orientation, and free of extraneous matter such as measurements, explanatory text or elements that are not part of the design. Inconsistent views can lead to objections, and they can also weaken later enforcement because the scope of the right becomes difficult to establish.

Where a feature is not intended to be claimed, it should be presented in a way that makes the disclaimer clear, and the same approach should be used across every view. Multiple designs belonging to the same class may be combined in one application, which keeps the portfolio manageable. Since amendments after filing are limited, the set of views should be finalized before the application is submitted rather than corrected afterwards.

National Filing or the Hague System

A design can be protected in Turkey by filing a national application with TÜRKPATENT or by designating Turkey in an international registration under the Hague Agreement, to which Turkey is a party. Priority of six months may be claimed from an earlier first filing under the Paris Convention. The Hague route suits portfolios covering several countries, while a national filing is often simpler where Turkey is the only territory of interest.

In both cases the design is examined for formal requirements and for the absence of clear grounds for refusal; there is no full substantive search of earlier designs before registration. Foreign applicants without a residence or place of business in Turkey must act through a registered attorney.
